الملخص
هدفت هذه الدراسة إلى بيان مدى حجية القسامة في الإثبات؛ حيث توصلت الدراسة إلى اعتبار القسامة حجة في الإثبات الجنائي يثبت فيها القصاص، أو الدية؛ شريطة الأخذ بالاحتياطات الأزمة التي نص عليها الفقهاء، إلا أن حجية القسامة في الإثبات أضعف من حجية (البينة، والإقرار)، كما بينت الدراسة أن الشريعة الإسلامية لم تضيق في وسائل الإثبات، بل عدت كل طريق منها أصل بنفسه، كما بينت أن الحكمة من القسامة: إظهار جريمة القتل، وتطبيق القصاص، أو الدية، حتى لا يهدر دم في الإسلام.

Abstract
This study aimed at stating the Authenticity of Alksamh in Evidence; where research found Alksamhas an argument in proof of criminal prove where retribution, or blood money; provided taking precautions crisis stipulated by scholars, but the authority of Alksamh in proof is weaker than authoritative (evidence, and acknowledgment) the study also showed that Islamic law has not narrowed the means of proof, but promised all out by himself, also it showed the wisdom of the Alksamh: Showing the murder, and the application of retribution, or blood money, in order not to waste blood in Islam
