حجية القسامة في الإثبات الجنائي في الفقه الإسلامي: دراسة فقهية مقارنة.

Abstract

الملخص هدفت هذه الدراسة إلى بيان مدى حجية القسامة في الإثبات؛ حيث توصلت الدراسة إلى اعتبار القسامة حجة في الإثبات ‏الجنائي يثبت فيها القصاص، أو الدية؛ شريطة الأخذ بالاحتياطات الأزمة التي نص عليها الفقهاء، إلا أن حجية القسامة في الإثبات ‏أضعف من حجية (البينة، والإقرار)، كما بينت الدراسة أن الشريعة الإسلامية لم تضيق في وسائل الإثبات، بل عدت كل طريق ‏منها أصل بنفسه، كما بينت أن الحكمة من القسامة: إظهار جريمة القتل، وتطبيق القصاص، أو الدية، حتى لا يهدر دم في ‏الإسلام.‏ الكلمات الدالة: القسامة، الإثبات، القتل، الدية.‏

Abstract ‎

This study aimed at stating the Authenticity of‏ ‏Alksamh‏ ‏in Evidence; where research found ‎‏ ‏Alksamhas an‏ ‏argument in proof of criminal prove where retribution, or blood money; provided taking precautions crisis stipulated ‎by scholars, but the authority of Alksamh‏ ‏in proof is weaker than authoritative (evidence, and acknowledgment) the ‎study also showed that Islamic law has not narrowed the means of proof, but promised all out by himself, also it ‎showed the wisdom of the‏ ‏Alksamh‏:‏‎ Showing the murder, and the application of retribution, or blood money, in order ‎not to waste blood in Islam Key words: Alksamh, proof, murder, blood money.‎
