ملخص
يتناول هذا البحث التجربة التشريعية في مجال الوقف، لاحدى أهم دول المغرب العربي وهي الجزائر باعتبارها من الدول المعترفة بالوقف، كنظام مالي قائم بذاته بنوعيه: الوقف العام والوقف الخاص، أو ما يعرف بالوقف الخيري والوقف الذري، وذلك عبر المراحل الثلاثة الشهيرة التي شهدها هذا الاقليم عبر التاريخ وهي: مرحلة ما قبل الاستقلال، ثم المرحلة الانتقالية بعد استقلال البلاد، لنختم بالمرحلة الراهنة للأوقاف وما انتهت اليه من تشريع.
Abstract
This paper addresses the study of the Algerian legislative experience in the field of "El-Waqf" (endowment), as a state that recognizing "Waqf" as a financial system itself as realized in two types: Private Waqf (Folksmen Endowment); and Public Waqf (Charitable Endowment), represented in the three main stages the region has witnessed through history: the pre-independent period, the post-independence interim period and finally the status quo of Waqf and its eventual pertinent legislations.
