ملخص
اهتمت الشريعة الإسلامية بالمحافظة على المال، وذلك بتنميته ومنع الاختلال عنه، ومن تلك الأحكام تحريم سرقة المال، ومع تقدم العصر ظهرت صور جديدة للسرقة، منها سرقة بطاقات الائتمان، وسحب الأموال من الصراف الآلي بواسطتها، أو استخدامها في شراء السلع، من هنا كانت هذه الدراسة لبيان التكييف الشرعي لهذه الجريمة, وهل تنطبق عليها أركان وشروط السرقة، وبالتالي تستوجب الحد، أم أنها من صور الاحتيال فتستوجب التعزير.
وقد اختارت الباحثة القول بأنها جريمة سرقة تستوجب الحد ،متى استكملت الأركان والشروط، وأوصت الباحثة بضرورة مراجعة التشريعات لسن القوانين الرادعة لهذه الجريمة، وضرورة التحذير منها، والأخذ بالإجراءات اللازمة للحد منها.

Abstract
Islamic Jurisprudence “Shari’a” has shown immense concerned with the preserving money through investing it and preventing misusing it, such cases can be seen in provisions prohibiting theft of money. As time has passed, many forms of theft have emerged, including theft of credit cards and thus withdrawing money from ATMs; or by using them to purchase merchandise. This study, therefore, has been conducted to demonstrate the legal diagnosis of this crime, and to show whether terms of theft can be applied to such a crime; and thus, if it necessitates the mandated ‘Had’ ; or would it be reduced to an act of fraud that necessitates ‘ta’zeer’ as estimated by the judge.
The researcher has chosen to say that it is a crime of theft that necessitates the mandated ‘Had’, as long as all conditions are met. The researcher recommended that legislations be reviewed and reconsidered to pass strict laws to face, warn against and minimize this crime through necessary measures
