dc.description.abstractالملخص يتناول هذا البحث المسائل الفقهية التي تتعلق بغير المسلمين في باب الوقف، حيث قام الباحث بجمع أقوال الفقهاء في هذه المسائل من المصادر الفقهية المعتمدة، ثم قام بدراستها وفق ما تقتضيه منهجية الدراسات الفقهية المقارنة. انتهى الباحث إلى أن نظام الوقف الإسلامي عالج وبوضوح الأحكام التي تتعلق بغير المسلمين من ذميين ومستأمنين ومرتدين وحربيين، سواءٌ كانوا واقفين أو موقوفاً عليهم، حيث يلاحظ اتفاق الفقهاء على إفساح المجال أمام المسلمين ليشملوا بأوقافهم غير المسلمين من أهل الذمة، كما يلاحظ أيضاً اتفاقهم على تصحيح الأوقاف الصادرة من أهل الذمة في الدولة الإسلامية، شريطة ألا تتعارض هذه الأوقاف مع النظام الإسلامي العام. يرى الباحث أن إحياء ثقافة الوقف وتعميمها بين المسلمين وغير المسلمين محلياً ودولياً يسهم في تعزيز روابط التعاون الإنساني المشترك، شريطة انضباطها بالأحكام الشرعية التي تحفظ لهذا التعاون توازنه واستمراره. Abstract The present study addresses the rules related to non-Muslims in Wakf issues. The researcher surveyed arguments presented by the Moslem scholars in such rules, as cited in the most reliable Islamic resources; he examined and reflected upon them as required by comparative jurisprudential study methods. The researcher concludes that the Islamic Wakf system clearly demonstrates the rules that relate to non-Muslims including in-custody ?dimmis?, patronized ?Musta?man?, apostate, and warrior people, whether they were wakf donors or wakf beneficiaries. It is noted that there is a consensus among the Moslim scholars on the opinion that wakf donated by Muslims could be extended to cover non-Muslim ?Dimmis? too, and that their arguments were coincided regarding legalization of a wakf donated by non-Muslim ?Dimmis?, in an Islamic state, provided that such wakf properties do not infringe the Islamic public order. In the researchers opinion, regeneration of wakf culture, being learned to both Muslims and non-Muslims, locally and internationally, would promote a stronger human cooperation and faster commonalities if only were controlled by the sharia rules, which secure a more balanced and sustainable cooperation.en_US
