الملخص
قام الباحث بدراسة الأحاديث المتعلقة بالسن الذي يحرم فيه الرضاع، وتبين له أن النصوص تشير إلى أن الرضاع المحرم هو ما كان في الصغر دون الفطام لكثرة الأدلة ووضوحها. وأما حديث رضاع سالم من سهلة "رضاع الكبير" فهي قضية لم تحدث إلا مرة واحدة ولم يرها جمهور العلماء حكماً عاماً ولا قضية مطلقة لكل أحد، فقد احتفت بها قرينة وسبب وهو التبني الذي كان حلالاً فحرم، والحكم إذا تعلّق بسبب ثبت بوجوده وسقط بعدمه، وقد أبطل التبني ولا يعمل برضاع الكبير ? والله أعلم-.
Abstract
In this study the researcher investigated the age at which breast feeding babies is forbidden. Breast Feeding that leads to forbidden marriage is the one that occurs at an early stage before weaning due to numerous and clear religious bits of evidence. The story of Salem fed by Sahleh, breast feeding a mature man has not occurred more than once, and jurisprudents have not taken it as a general rule or absolute since it was viewed as a normal practice of adoption that was allowed then. some decision are closely associated with their reasons and as soon as these reasons disappear such decisions become invalid. Since adoption is illegal nowadays, hence feeding mature people is not allowed.
