المواطنة ومقوماتها في الدستور الأردني لسنة 1952م

Abstract

المُلخَّص المواطنة مفهوم متغير وغير ثابت على مرّ العصور والأزمان، وترتبط ارتباطا وثيقا بالحقوق والحريات، وخاصة الحقوق والحريات السياسية، ولا يمكن فهم جوهرها ومضمونها إلا بفهم المنظومة التشريعية للدولة، فتغدوا شعورا عميقا يتجاوز مفهوم الانتماء إلى جماعة ما،إلى الولاء لتلك الجماعة، نظراً لما يتمتع به صاحب ذلك الشعور من حقوق وحريات تميزه عن الأجنبي فيندفع مختاراً للمشاركة في شؤون الدولة المختلفة وأداء ما يترتب عليه من واجبات والتزامات. وعند تتبع المنظومة التشريعية الأردنية (الدستور وبعض القوانين والأنظمة التي تتعلق بالحقوق السياسية)، نجد أنها تخلو من لفظة المواطنة، ولكنها تتضمن جوهرها ومضمونها المرتكز على الجنسية، والعدالة، والحرية، والمشاركة السياسية والمساواة، ورغم ذلك يلاحظ غياب هذا الشعور على أرض الواقع.

Abstract

Citizenship has been a variable concept, being interrelated with the rights and freedoms (mainly political rights and freedoms). Hence, citizenship to be explicated and identified need be rooted into an understanding of the legislations of the country. This may lead to transforming citizenship from a mere sense of belonging to a group to a loyalty to that group, due to the individual's satisfaction with the rights and freedoms he/she has been granted, rights and freedoms that make them feel privileged over foreigners and motivated to be committed more actively to performing their obligations and duties. Tracing the Jordanian legislative heritage (constitution, laws, and regulations pertaining to political rights), it is found that such domains include at their essence notions of justice, freedom, political participation, and equality but, in the meantime, they lack any direct reference to the concept 'citizenship', with the result being an absence of the feeling of citizenship in communal actuality
