Abstract: مُلخَّص تتلخص الدراسة حول الآثار المترتبة عن الأخذ بالشفعة، وفق التكيف التي أخذت بها، فهناك جانب من التشريعات عدّت أن الشفعة هي تحويل للحقوق والالتزامات بين البائع والمشتري، إلى ما بين البائع والشفيع، وجانب آخر عدّ أنَّها بمنزلة عقد جديد بين المشتري والشفيع، فيكون الشفيع قد اشترى من المشتري نفسه، فيلتزم الأخير تجاهه بجميع التزامات البائع، ويواجهه الشفيع بجميع التزامات المشتري، وكلا النظامين استمد تلك الأحكام من الفقه الإسلامي، والذي اختلف فيه الفقهاء، أيضاً، حول كيفية انتقال الملكية للشفيع، فبعضهم يرى: أنَّ البيع الذي جرى بين البائع والمشتري ينتقض وينعقد للشفيع بيع آخر، ويرى آخرون: بأن الصفقة تتحول إلى الشفيع مباشرة Abstract The study discusses the consequences of taking preemption. A number of researchers consider it as a change of rights and obligations between the seller and the buyer to be between the seller and the intercessor. Another group considers preemption as a new contract between the seller and the intercessor. In this contract, intercessor bought real estate from the seller himself, and as a result the seller must adhere to the intercessor in all seller's obligations. Both approaches are based on Islamic Law. Scholars, further, differed on how to transfer the property of the intercessor. Some sees that the sale, which happened between the seller and the buyer, is void and held for the intercessor of last sale; and others see that the transaction goes directly to the intercessor.
