حقوق وامتيازات ورثة الشهيد في التشريع الأردني

Abstract

المُلخَّص جاءت هذه الدراسة، لمعرفة الحقوق والامتيازات التي نص عليها التشريع الأردني لورثه الشهيد، وهدفت هذه الدراسة إلى معرفة النصوص القانونية التي نصت على هذه الحقوق والامتيازات ومعرفة النقص في هذه النصوص، إذ إن مشكلة الدراسة تكمن في عدم معرفة الشروط الواجب توفرها حتى يعد المتوفَّى شهيداً، كما أنه يوجد نقص في النصوص القانونية التي نصت على حقوق ورثة الشهيد وامتيازاته، وقد توصل الباحث إلى عدة نتائج وقام بمعالجة بعض النقاط منها على سبيل المثال لا الحصر، وضع تعريف قانوني للشهيد واضح وثابت، من حيث الصياغة والمضمون، وتعديل بعض النصوص القانونية وأهمها تعديل المواد (14، 22) من قانون التقاعد العسكري، وختمت الدراسة بعدد من التوصيات. الكلمات الدالة: الشهيد، التشريع الأردني، حقوق، امتيازات. Abstract This study was conducted to verify the rights and privileges stipulated by the Jordanian legislation to the heirs of the martyr. It also sought to determine the deficiencies in knowledge for these texts. Among the problems this study showed was the lack of documented conditions that must met to state that this dead person is martyr. The study provided some recommendations to improve the situation, and has treated some of the points that this issue struggles with. For example, the development of legal drafting of the definition of a martyr and a clear and consistent definition in terms of language and content, and modifying some of the legal texts and the most important amended articles (14. 22) of the military Retirement Act.
