الملخص
لقد فرَّق المشرِّع الأردني في كيفية إجراء التبليغ القضائي بين الأشخاص الاعتبارية العامة والخاصة ، حيث وضع لكل منها قواعد خاصة تختلف عن الأخرى ، إلا أنه ساوى في تلك القواعد بين الأشخاص الاعتبارية الخاصة على اختلافها، سواء من حيث الأشخاص الذين يجوز تسليم التبليغ القضائي إليهم، أو من حيث مكان التسليم، وذلك في المادة 10/5 من قانون أصول المحاكمات المدنية، ولما كانت الشركات التجارية تختلف في أشكالها، سواء فيما يتعلق بتكوينها، أو الهيئات، أو الأشخاص القائمين على إدارتها، وكذلك فيما يتعلق بممثليها والمفوضين عنها . من هنا جاءت هذه الدراسة لتوضيح كيفية إجراء التبليغ القضائي لكل شكل من أشكال الشركات التجارية، سواء فيما يتعلق بالأشخاص الذين يجوز تسليم التبليغ القضائي إليهم، أو المكان الذي يتم فيه تسليم التبليغ.
Abstract
The Jordanian legislator differentiated in the means of service of process (judicial notification) between public entities and commercial companies by setting certain procedures for each one of them. On the other hand, there are similar rules stipulating who is the qualified person to receive the service of process and the location of such notifications in accordance with article 10/5 of the Civil Procedures Law. It is well-known that commercial companies have many forms which lead to essential differences in their formation and management especially in terms of their representatives. Therefore this research explained how service of process is conducted to each form of commercial companies in regards the persons who are qualified to receive such notification and its location
