Abstract

الملخص

إن مما ظهر حديثاً من النظريات القانونية العامة نظرية الظروف الطارئة, وإن لهذه النظرية في الفقه الإسلامي تطبيقات فقهية عديدة تحت اسم العذر والجوائح وتغير قيم النقود ونحوها, وإن من النظم التي اختلطت بنظرية الظروف الطارئة: القوة القاهرة وفعل الأمير والصعوبات المادية, والغبن اللاحق, والاستغلال, والإذعان وغيرها, وقد جاء هذا البحث لبيان الفرق بين القوة القاهرة والظروف الطارئة. وتبين بعد البحث والتمحيص أن هناك أوجه اتفاق واختلاف بينهما, وإن من أوجه الاتفاق: وحدة الأصل والمنشأ, وعدم التوقع وعدم القدرة على الدفع, والأثر, ووقت الاعتداد بهما, ومصدرهما. في حين تتلخص أوجه الاختلاف في أمور منها: علاقتهما بفكرة النظام العام, وشرط العمومية, والإثبات, ومجال التطبيق, والقانون المختص بالنسبة للأشياء محل الالتزام وغيرها.

Abstract

Urgent Circumstances and pressing powers: A Comparatives study between force Islamic Doctrine and Man- Made legislation. The theory of urgent circumstances is considered one of the legal theories that have several applications in Islamic doctrine and these applications come under different names. Among the systems which merged with this theory are the Pressing Power, material hard ships, injustice, exploitation, acquiecnce, etc? This research investigates the differences between Pressing Power and the theory of urgent circumstances. After investigation, it is found that there are many similarities and differences between the two theories. The similarities include the uniformity of origin, inability of expectation, inability of obviates, etc.
