Abstract

ملخص تتناول هذه الدراسة موضوع المسؤولية المدنية للوكيل بالعمولة للنقل كدراسة مقارنة بين القانونين الأردني والمغربي؛ باعتباره من أهم وأخطر المواضيع التي تثار في ميدان الوكالة بالعمولة بصفة عامة والوكالة بالعمولة للنقل على وجه الخصوص، حيث يقوم الوكيل بالعمولة للنقل بالتصرف القانوني باسمه الشخصي، مما يجعله ذلك طرفاً أصيلاً في العقد يتحمل كافة الآثار التي قد تنجم عنه. وقد أخضع كل من المشرّعين الأردني والمغربي الوكيل بالعمولة للنقل فيما يختص بعملية نقل البضائع بنفسه كجزء من المرحلة للأحكام التي يخضع لها ملتزم النقل، هذا ولم ينظم المشرّع الأردني – خلافاً للمشرّع المغربي – مسألة توزيع المسؤولية بين الناقلين المتعددين المتعاقبين. الكلمات الدالة: الوكالة، الوكالة بالعمولة، النقل المتعاقب، مسؤولية الوكيل.
