موضوع تخصیص العام بالغایة یُعدُّ من جلیل مباحث علم الأصول؛ لما یُعطیه للمجتهد من
حُسْن فهم للنّصوص الشرعیة، من حیثُ دلالتُها على الشّمول أو قصرها على بعض أفرادها. كما تبرز
أهمیةّ هذا البحث في الاستعانة به في فهم خطاب المكلفّین في وصایاهم وإقراراتهم وأوقافهم وأیمانهم
ونذورهم.
ویتناول البحثُ مفهومَ الغایة عند الأصولیّین وحقیقته وحجیته، وبیان مكوناته ومعرفة أدواته.
ثم طرقتُ حكم أدوات الغایة وبیان مذاهب العلماء فیها، وختمتُ البحثَ بأمثلة عن مفهوم الغایة في
والآثار الفقهیة المبنیة على نصوص القران والسنة. كتاب الله، وفي سُنّة رسولِ الله
Abstract
The subject of specifying the general by aims and ends (alghayah) is one of the
most important subjects in the field of usul al-fiqh, this is because it enables jurists to
better understand legal texts and to determine whether they are general in meaning or
specific. This paper helps readers to understand texts in fields of legal wills, approvals,
endowments, vows and oaths. The research also discusses the concept of al-ghayah, its
reality, elements, tools, rulings and the views of scholars regarding it. The research also
gives examples on the use of al-ghayah with Qura'anic and hadithi texts.
