حكم شهادة النساء في القصاص

Abstract

تعد الشهادة واحدة من أهم وسائل الإثبات في جریمة القتل العمد وحتى تكون هذه الشهادة معتبرة ویترتب علیها أحكامها اشترط الفقهاء شروطا لقبولها. كما تباینت آراؤهم في شروط أخرى منها: الذكورة؛ فقد ذهب جمهور الفقهاء إلى اعتبار هذا الشرط، وان الذكورة شرط في قبول الشهادة، وان له اثر في إثبات الجریمة، أو نفیها، في حین ذهب الظاهریة ومن وافقهم إلى عدم اعتبار شرط الذكورة، وأن شهادة المرأة تقبل في القصاص بشروط مخصوصة، وهذا ما بحثته الدراسة. كما قام الباحث بتعریف الشهادة والقصاص وبیان مشروعیتهما، وحكمة مشروعیتهما، وشروطهما، ثم انتهى البحث إلى أهم النتائج التي توصل إلیها. الكلمات الدالة: الشهادة، التحمل، القصاص، الإثبات.
