لا ينكر تغيير الاحكام بتغير المناطات واثر ذلك في الاختلاف الفكري

Abstract

یتناول هذا البحث بالشرح والبیان قاعدة فقهیة ومقصدیة جلیلة، هي تغیر الأحكام بتغیر المناطات، فیبین أهمیتها، ویحرر مصطلحاتها تحریرا علمیا دقیقا، ثم یؤصلها تأصیلا وافیا من الكتاب والسنة من خلال بیان سَنَن التشریع في مراعاة الظروف ومناطات الأحكام، سواء ما تعلق بالخصوصیات الاجتماعیة العامة، أم بالخصوصیات الفردیة، كما یبین البحث أن اقتضاء الأدلة للأحكام ینقسم إلى اقتضاء أصلي واقتضاء تبعي، وأن تحقیق المناط ینقسم إلى تحقیق عام وتحقیق خاص، ویسوق البحث ومن بعدهم من كبار الأئمة والعلماء على تقریر هذه  الشواهد العدیدة من فقه السلف: الصحابة الحقیقة الشرعیة، كما یلفت البحث النظر إلى الفرق بین النسخ وتبدیل الشریعة، وبین المقصود بتغیر الأحكام، وا لٕى أن الأحكام لیست كلها قابلة للتغیر، ویختم البحث ببیان الأثر الفقهي الكبیر لهذه القاعدة على معتر كات الخلاف والترجیح من خلال نموذج تطبیقي لمسألة خلافیة معاصرة، هي إثبات أوائل الشهور القمریة بالحساب الفلكي المعاصر.
