تهدف هذه الدراسة إلى توضیح مفهوم تشجیع الاستثمار وبیان الضوابط الشرعیة التي ینبغي أن یلتزمها وبخاصة في
ظل ما یواجهه العالم الیوم من سلبیات الأزمة الاقتصادیة العالمیة، وفرط عمل أنظمة مؤسسات تشجیع الاستثمار في العالم
الیوم.
وقد تناولت هذه الدراسة الاستثمار من حیث مفهومه وأشكاله والضوابط الشرعیة لتشجیعه، وذلك من خلال المنهج
الاستقرائي والمنهج الوصفي التحلیلي.
ومن أبرز ما توصلت إلیه الدراسة: أن الضوابط الشرعیة لتشجیع الاستثمار هي تلك الأحكام الكلیة التي تندرج تحتها
مجموعة من الأحكام المتعلقة بإیجاد الدافعیة، وترسخ القناعة عند أصحاب رؤوس الأموال لتوظیف أموالهم وفق الطرق
الشرعیة لنمائها وغیره، وأن من أبرز تلك الضوابط: أن یكون المشروع الاستثماري الحاصل على المنح والتسهیلات جائزا
شرعًا، ونافعًا للمجتمع محققا لمصالحه، وأن یكون مراعیًا لأولویات المجتمع الإسلامي. ویوصي الباحث بإقامة المؤتمرات
. یا والندوات التي من شأنها أن تعمق فهم تلك الضوابط وبیانها بكل وضوح، ومن ثم تعمیق المعرفة المجتمعیة بها نظریًا وعمل
Abstract
This study aims to clarify the concept of investment promotion and the statement of Sharia, which
should be taken especially in light of what the world is facing today, the negative aspects of the global
economic crisis and hyper systems work of investment promotion institutions in the world today.
This study has addressed the investment in terms of concept and forms of legitimacy and controls to
encourage, through the inductive approach and the descriptive analytical method.
The main findings of the study: that the Shariah to encourage investment are those provisions of the
total falls below a set of provisions related to a motivation and strengthen the heart when the owners of
capital to use their money according to the methods legitimacy to pursue their and others, and of the most
prominent of these controls: The project should be the investment sum on grants and facilities legally
permissible, and beneficial to the interest of the community interests, and be sensitive to the priorities of
the Muslim community. The researcher recommends the establishment of conferences and seminars that
