حق الله وحق العبد وأثرهما في الحدود

Abstract

  تتنوع العقوبات في الإسلام إلى ثلاثة أنواع؛ حدود، وقصاص، وتعزیر، ولكل نوع منها أحكامه التي یختلف فیها عن غیره، أو یشترك معه فیها؛ بناء على كون الحق في إقامة هذه العقوبات راجعا إلى الله تعالى وهو المعبر عنه بحق المجتمع، أو كونه راجعا إلى العبد. وقد بینت الدراسة معنى الحق وأقسامه، والثمرات التي انبنت على تقسیم الحق إلى حق الله تعالى، وحق العبد، كما بینت أن الضابط في تمییز ما هو حق لله تعالى من العقوبات عما هو حق للعبد أمران: أحدهما: مدى احتیاج الناس لذلك الأمر، والخطورة التي تسببها الجریمة للمجتمع، والثاني: مدى جواز تصرف العبد في الحق بالإسقاط، والعفو، والصلح وغیره. إن تقسیم الحق إلى حق الله وحق العبد ینبني علیه عدد من الآثار الفقهیة، وكان له أثر في اختلاف الفقهاء في مسائل فقهیة في باب الحدود بینتها الدراسة؛ وهي: أثر تقسیم الحق إلى حق الله وحق العبد في العفو عن العقوبة، وفي تنفیذ الحد، . ف وفي تداخل الحدود، وأولویة تنفیذها، والأثر الفقهي لاختلاف الفقهاء في مرجعیة الحق في حد القذ Abstract The punishments in Islam are three types; limits, the punishment, and promote, and each type of provisions that differ in the other, or participate with them; building on the fact that the right to establish such penalties due to God is expressed in the right of society, or being due to all.
