ملخص
تهدف هذه الدراسة الى تحليل أثر مؤسسات المجتمع المدني على التعديلات الدستورية في الأردن خلال مرحلة التحول الديمقراطي الممتدة من عام 1989 الى عام 2012م وعلى التطور في حالة احترام الدستور والالتزام به, وذلك مقارنة مع الفترة السابقة لعام 1989، وفيما إذا كانت هذه التعديلات تعزز العملية الديمقراطيه وترسخها ، ثم معرفة ماهية هذا الأثر إن وجد سواء كان إيجابياً أم سلبياً أم محايداً. وذلك من خلال الاجابة على الاسئلة التالية:
- هل شهد الدستور خلال مرحلة الدراسة تغيرا إيجابيا يعزز من العملية الديمقراطية بشكل يقترب من المؤشرات العامة للدساتير الديمقراطية ؟
- هل كان لمؤسسات المجتمع المدني أثر على الدفع باتجاه إجراء التعديلات الدستورية وحالة احترام الدستور والالتزام به ؟
وكانت اهم النتائج: ان هناك علاقة ايجابية بين مؤسسات المجتمع المدني والتغير الايجابي على صعيد الدستور خلال مرحلة التحول نحو الديمقراطية، سواء فيما يتعلق بتعزيز التعديلات الدستورية للعملية الديمقراطية وعملية التحول نحوها ، أو على صعيد احترام الدستور والالتزام به.
"The Influence of Civil Society Organizations on Enhancing the Constitution in Light of the Transformational Process of Democracy in Jordan (1989-2012)"
Abstract
This study aims to analyze the influence of civil society organizations on the constitutional changes in Jordan in light of the democratic change phase 1989-2012. The researcher discusses the possible influences of the related civil society organizations on the constitutional changes and developments in Jordan in the aforementioned time period. it also deals with the extent to which these organizations respect the constitution. This is compared to the period before 1989 and the development of this status during the change
towards democracy, and whether these changes enhance the course of democratic process. Then, it defines the substance of this influence, whether positive, negative or neutral, through answering the following questions:
- Did the constitution indicator in this study witness a positive change that coincides with the general indicators of democratic constitutions?
- Did the civil society have an influence on the constitutional changes, and the status of respect and commitment to it?
The study concludes that there is a positive influence between civil society organizations and the positive change on constitutional indicator through the phase of democratic change in respect to enhancing constitutional changes of the democratic process, or the change process towards the constitution and the commitment to it.
