الملخص
يهدف هذا البحث إلى استخلاص الصور المتعلقة بالقضاء من الحوارات القرآنية المتنوعة، إظهاراً لبعض كنوز القرآن العظيم، وكشفا عن مدى اهتمامه بهذا الركن المهم من ضرورات الحياة الإنسانية الذي يهدف إلى إرساء قواعد العدل بين الناس، وإظهار العيوب والمزالق التي يقعون فيها حين يحكمون بغير شريعة السماء. وتتلخص منهجية البحث بإجراء دراسة لنماذج من الحوارات القرآنية ذات الملامح القضائية في صور متنوعة وتسليط الأضواء على هذا الجانب، مع إبراز موقف الحق المتوافق مع مقاصد القرآن. وأسفرت هذه الدراسة عن إبراز صور من الإجراءات القضائية من محاكمات وتحقيقات ومجالس قضائية، وإصدار أحكام ونقضها، وصور من أساليب البحث والتحري وطرق الإثبات، وصور من المرافعات والمحاماة تضمنت بيان دور المحامي ومقوماته، مع الإشارة إلى مثيلاتها في القوانين الشرعية والوضعية السائدة يمكن الإفادة منها في الكشف عن الهدي القرآني، مع تسليط الأضواء القرآنية على الإجراءات البشرية في هذا المجال وتصويبها.
Abstract
This paper aims at extracting the metaphors associated with judiciary form the various Quranic dialog, displaying some of the treasures of the holy Quran and uncovering its great interest in this fundamental pillar of the human life, which aims at founding the fundamentals of justice between people and uncovering the flaws and the uncertainties people commit when judging with out the law (shreaa)of Heavens. The method of the research followed of some models of the Quranic dialogs characterized by judicial images in various images, shedding light on this side, in addition to stressing the righteous position corresponding with the aimed of the Quran. The study outcomes revealed images of the judicial procedures proceedings, investigations, judicial councils, rendering and refuting a verdict, images of inquiry and substantiation, images of legal proceedings and advocacy, which displayed the qualities and the role of advocacy. The study also referred to similar prevailing the theocratic law (Shareaa) and the secular law, which can be used to uncover the Quranic guidance and shed Quranic light on, and correct the secular proceedings in this field.
