الملخص
تهدف هذه الدراسة إلى تقديم فكرة عن صور نظر الرجل إلى محارمه من الإناث، وأحكام تلك الصور، وما يترتب على ذلك من آثار فقهية، من خلال دراسة متأنية ومستفيضة لأقوال الفقهاء، ورصد فاحص لأدلتهم، وعرض تحليلي لمناقشاتهم وإيراداتهم، مع الأخذ بعين الاعتبار الواقع المعاش، للوصول إلى ترجيح ما يظهر بالدليل رجحانه في ضوء مقاصد الشريعة في هذا العصر، وذلك من خلال: مقدمة وثلاثة مطالب، عرضت في أولها لمقدمات الدراسة ومداخلها كمفهوم المحرم والعورة وتحرير محل النزاع، وأفردت ثانيها لدراسة مذاهب الفقهاء وأدلتهم ومناقشاتهم، وسطرت في ثالثها ما ظهر لي بالدليل رجحانه، رجاء أن تكون هذه الدراسة إسهاما متواضعا في البناء المعرفي للفقه الإسلامي.
Abstract
This study aims to assess the cases of mans looking to his Maharim, (i. e. the prohibited ladies for marriage to him). It provides the rulings for these cases and the consequences resulted in accordance with Islamic Jurisprudence. This is performed a deep discussion for the opinions of the jurists and their evidence, in order to reach to a precise selected judgment. The paper is divided into an introduction, three sections and a conclusion. The first section highlights the introductory themes such as; the concept of al-Maharim and al-Awrah, i. e. the private part of the individual. This is in addition to the specification of disagreement scope. The second tackles the jurists opinions, their proofs for them and the discussion. The third assesses the selected opinion which is supported with personal substantiation. Hoping that this effort provides a contribution to the field of Islamic Jurisprudence.
