الملخص
يتناول هذا البحث آراء الإمام البريلوي (1856-1921)، المتعلقة بمالية وثمنية النقود الورقية والمتضمنة في كتابة "كفل الفقيه الفاهم في أحكام قرطاس الدراهم" الذي صنفه في العقد الأول من القرن العشرين، وخصصه لبحث هذا الموضوع، وقد قام هذا البحث بعرض تلك الآراء ودراستها وبيانها في ضوء الفقه والفكر الاقتصادي الإسلامي. وقد خلص البحث إلى أن البريلوي يثبت مالية النقد الورقي ويمنحه أحكاما خاصة من منطلق ماليته، أما فيما يتعلق بثمنية النقد الورقي فإن البريلوي يقسم الثمنية إلى عدة أقسام منها: الثمنية الخلقية ومنها الثمنية الاصطلاحية، وهو لا يلحق ثمنية النقود الورقية بالثمنية الخلقية المتمثلة بالذهب والفضة، بل يعترف لهذه النقود بالثمنية الاصطلاحية، ويلحقها بالفلوس ويمنحها أحكاما فقهية خاصة بها مختلفةً عن أحكام النقود الخلقية.
Abstract
This paper aims to study the opinions of Al- Imam Al-Biralw? (1856-1921), in his book " Kifl al-Faq?h al-F?him f? A?k?mi Qir??s ad-Dar?him "which deals with Maliah and Thamaniah of Al-Nuqud Al-Waraqiah (paper money as part of wealth, and its ability to do the functions of money). These opinions were included in his book which he authored at the beginning of the twentieth century. This paper displayed and studied Al-Biralw?s opinions in the light of Islamic economic thought and fiqh. It concluded that he believed that paper money is part of wealth and it can have the functions of money because the society accepted and approved it as money. 0n the other hand, the Imam did not give it the same juristic rules which related to Al- athamn Al-Khalqiah (gold and silver money) but he conceders it as Fulus (copper money) and granted it other rules.
