علاقة قواعد تفسير العقد بقواعد تفسير النص القانوني في القانون المدني الأردني

Abstract

يهدف هذا البحث إلى بيان علاقة تفسير العقد بتفسير النص القانوني حسب القواعد الواردة لكل منهما في القانون المدني الأردني، إذ لا يخفى أن العقد قد يكون ملفوظ أو مكتوب مسوق ليعبر عن مراد العاقدين، وكذلك النص القانوني فهو كلام مكتوب مسوق للتعبير عن إرادة المشرع، ولهذا فلا بد أن يشترك العقد والنص القانوني في العناصر الداخلية للتفسير ، وهي التفسير من خلال الرجوع إلى الألفاظ وما تحتمله من معان، وهنا يمكن الرجوع إلى القواعد المعروفة عند علماء أصول الفقه الإسلامي في تفسير النصوص، والتي اشتمل القانون المدني الأردني على الكثير منها، أما العناصر الخارجية في التفسير ، كالتفسير بالاعتماد على طريقة تنفيذ المتعاقدين للعقد ، أو الاعتماد على وسائل الإثبات في التفسير ، أو الرجوع للعرف والعادة ، فهناك أوجه اختلاف سترد في هذا البحث. Abstract This study discussed the relationship of the rules of interpreting the contract by using its related rules in the Jordanian civil law. It is well known that the contract might be through a spoken or written speech that expresses the intention of the contracting parties. Also that the legal text is a written speech that expresses the intention of the legislator. Therefore, the contract must contribute with the legal text in the internal elements of interpretation, which means to refer to words and what they bearof meanings. Here, we may refer to the known rules among scholars of usool of Islamic feqh in interpreting texts, most of which are included in the Jordanian civil law. The external elements of interpretation, as in interpretation depending on the method of execution adopted by the contracting parties, or depending on the methods of proof in interpretation, or by referring to practice and habit, there are aspects of agreement that are mentioned in this study.
