يهدف هذا البحث إلى بيان حكم الشريعة الإسلامية والقانون في إفشاء سرّ المريض من خلال معرفة مفهوم السر،
وواجب الطبيب نحو المريض وبيان الحالات التي يجوز فيها كشف هذا السرّ والأصل الشرعي والقانوني لذلك
وإذا حصل من الطبيب إفشاء لسرّ المريض دون ضرورة أو حاجة فإنه يمثل اعتداء على حق من حقوقه، وهو
وجوب كتمان سره، وعلى هذا فإن الشريعة الإسلامية ومختلف التشريعات الوضعية ترتب عقوبة على هذا الطبيب ضمانا
لحق المريض ولمعالجة الآثار المترتبة على هذا الضرر.
Abstract
This study discussed the judgement of revealing patient's secret in the Islamic Sharia and law
through pointing out the concept of secret, doctor's responsibilty towards the patient, pointing out the cases where a secret may be revealed, and the Sharia and legal background. If the doctor reveals a patient's secret without necessity or need to do so, it will be considered as a breach of one of his rights, which is the obligation to keep the secret. Therefore, Islamic Sharia and most of other civil doctrines entitles a punishment on the doctor, as a guarantee for the patient's right and to handle the consequences of that damage
