حق الامتياز هو ما كان له أولوية التقدم في الاستيفاء على غيره من الحقوق لاعتبارات خاصة. والأصل في عقد الإجارة تساوي وتكافؤ المؤجر والمستأجر في استيفاء الحقوق، فلا امتياز لأحدهما على الآخر، ولكن قد يثبت لأحد العاقدين حق أولوية وامتياز في استيفاء حقه والتقدم على غيره لاعتبارات معينة، كأن يكون لعمل الأجير أثر في العين التي استؤجر للعمل بها، أو يتعلق حق المستأجر بالعين المستأجرة ذاتها، أو يتعلق حق المؤجر أو صاحب الفندق أو النزل بما فيه من الأمتعة والأثاث.
Abstract
The privilege right is that who has preference priority in receiving on other rights for special
considerations. Originally in the rent contract the evenness and equality between the property owner and the renter in receiving rights, hence no privilege to one of them on the other, but it may be confirmed to one of the two contracting parties his preference right and privilege in receiving his right and his priority on the others for specific considerations, such as the employee work if it has an effect on the property which he was hired to work in, or the renter right connects to the rented property itself, to the property owner right or the hotel or inn owner connects to what in it from belongings and furniture.
