يعد التلفيق في التقليد بين المذاهب الفقهية الإسلامية اليوم مما تدعو إليه الضرورة أو الحاجة العامة التي تنزل منزلتها؛
لتصحيح التصرفات الشرعية الواقعة من كثرة كاثرة من المسلمين بسبب قلة اعتنائهم بإيقاع أي من تصرفاتهم تلك على وجه
يصح معه التصرف كله على مذهب واحد لا أكثر من تلك المذاهب الفقهية. ولو لم يكن من داع إلى تجويز التلفيق بين
المذاهب إلا هذا التصحيح لتصرفات المسلمين، لكفى وحده، فكيف وجواز هذا التلفيق بشرط عدم مخالفة الإجماع القطعي هو
الصحيح الراجح الذي يحسن المصير إليه في حكم التلفيق في التقليد ؟! على أن العلماء مختلفون في مشروعية التلفيق بين مانع منه مطلقا، ومجيز له مطلقا، ومجيز له بشروط اختلفوا في تعيينها أيضا، وهو ما يتولى هذا البحث بيانه وتفصيله.
Abstract
The combination of the tradition between the Islamic doctrine today than is necessary or the need to go public standing; actions to correct the legitimacy of many of the Muslims, because of the lack of interest in the imposition of such actions on the image of the true disposition of the whole doctrine of no more than one of doctrine. Scientists may be different in the combination of mind it at all, and it never permissive, and an endorser of the conditions being identified also differed; Therefore, this research comes to demonstrate the doctrine is likely in this matter after considering the evidence of the parties, which had determined the outcome of this research and diligence are not purely on the tradition.
