يتناول هذا البحث جملة من الضوابط والآليات التي ذكرها الفقهاء قديماً فيمن يتقلد منصب الإفتاء وذلك بذكر شروط
المفتي، وكذلك ما ذكره العلماء المعاصرون في هذا الموضوع
وقد تناول البحث أيضاً تجربة دائرة الإفتاء العام في المملكة الأردنية الهاشمية أنموذجاً تطبيقياً لهذا الموضوع وذلك من
خلال الدراسة التطبيقية لضوابط وآليات اختيار وتعيين كل من:
أولاً: المفتي العام.
ثانياً: مجلس الإفتاء والبحوث والدراسات الإسلامية.
ثالثاً: تعيين المفتي.
واعتمد الباحث في بحثه المنهج الاستقرائي والوصفي والتحليلي وحقق آليات ذلك من خلال القيام بخطوات البحث العلمي
والمقابلات الشخصية في دائرة الإفتاء العام.
Abstract
This paper deals with a set of Restrictions and Mechanisms, mentioned by the ancient Islamic scholars in Figh, about the person who holds the Ifta' post, by defining the conditions for Almofti, in addition to the contemporary scholars on this subject.
The paper deals also with the experience of the public Department of Islamic Ifta' in the Hashemite
Kingdom of Jordan, as an applied example for this subject, through the applied study of those restrictions and mechanisms used in choosing and employing each one of the following:
The public Mufti, The Ifta' and Islamic studies and Research council, and Employing the Mufti.
