تجارة الهامش أو التجارة عبر الهامش من القضايا المستجدة في هذا العصر، وقد انتشرت انتشاراً واسعاً في الأسواق
المالية المعاصرة، وبخاصة في المتاجرة في الأوراق المالية كالأسهم والسندات أو العملات.
وتهدف هذه الدراسة إلى بيان مفهوم الهامش وأنواعه، وصور البيع به كتجارة الهامش في السلع والأوراق المالية، والعملات
وذكر آراء الفقهاء وأدلتهم ومناقشتها، وبيان الراجح منها ، ثم تلخيص نتائج البحث.
ومن نتائجه أن التعامل بالهامش في سوق العقود السلعية، والأوراق المالية، والعملات بفائدة أو دون فائدة حرام شرعاً؛ لأن
أظهر ما تضمنته هذه المعاملات هو الربا والمقامرة، والمخاطر الكبيرة جداً في هذا النوع من العقود.
Abstract
Margin trading or trading on margin are new issues in this time, this trading spread widely in the
contemporary financial markets specially in trading in securities as stocks, bonds and currencies.
This study aims at both explaining the concept of Margin as well as its types and selling types as Margin trading in goods, securities, and currencies, it also aims at mentioning the Fuqua legal opinions evidences and their discussion, to show the best opinion and to summarize the research results.
And of the results is that trading on Margin in future market and securities and currencies with
interest and noninterest is forbidden in sharia' because usury, gambling, and high risk are implied most in this type of contracts.
