العذر حقيقته وأثره في عقد الإجارة عند الحنفية

Abstract

تتناول هذه الدراسة موضوع العذر الذي يطرأ على عقد الإجارة بعد إبرامه، مما يجعل تنفيذ التزاماته مضرا بأحد طرفي التعاقد ضررا بالغا لم يكن منصوصا عليه في العقد، مما يحدث إخلالا بالالتزامات التعاقدية، ومقارنة ذلك بالحادث الطارئ في القانون الوضعي, وقد خلصت الدراسة إلى أن مضمون العذر عند فقهاء الحنفية يفوق نظرية الظروف الطارئة التي نادت بها القوانين الوضعية، حيث راعى فقهاء الحنفية ظروف العاقد الخاصة، في حين اشترطت القوانين الوضعية مبدأ العمومية، وأن العذر كما يصلح لفسخ العقد يصلح لإبقائه و استمراره، وقد راعى فقهاء الحنفية المعيار المعنوي أو النفسي في تقدير العذر كما راعوا المعيار المادي جنبا إلى جنب. وخرجت الدراسة بأن قول فقهاء الحنفية بالعذر قد فتح الباب أمامنا لإضافة كثير من الأعذار التي تتلاءم وتغيرات الزمن الذي نعيش دون الاقتصار على ما نصوا عليه قصدا. Abstract This study deals with the topic of the emerging excuse on the complete hiring contract. The fulfillment of the contracts in such cases will be harmful for one of the contract parties and this would cause violation of the contract obligations. The study followed a comparative approach with the encounter case in the man-made laws. The study concluded that the concept of excuse according to the Hanfai School of thought has excelled the countering man-made law Theory of "Emergency Circumstances". The Hanafites considered the personal circumstances of the contractors meanwhile man-made laws considered the principle of generalization and that the excuse as well as it invalidates the contract it can be a reason of its the continuity. Hanafites also considered the psychological criterion besides the material one in accepting the excuse. The study concluded also that Hanafites consideration of the excuse has opened the door widely to add to the list many of the excuses which suites our contemporary circumstances and can adjust with the changes of our modern time.
