وقوع الطلاق في الحيض دراسة فقهية مقارنة

Abstract

يسعى هذا البحث إلى مناقشة وقوع الطلاق في الحيض، وذلك من خلال بسط آراء الفقهاء في هذه المسألة ومناقشتها، ثم الخلوص إلى الرأي الراجح المحقق لمقاصد الشريعة الإسلامية في المحافظة على النسل من جانب الوجود والعدم، مما يحقق استقرار الحياة الزوجية وعدم الإضرار بالزوجة ودوام المعاشرة بالمعروف. الكلمات المفتاحية : الطلاق ، الحيض. Abstract This study discusses the occurrence of divorce during menstruation, through pointing out scholars' opinions in this issue. The study concluded to a preferred opinion that achieves the Islamic Sharia objectives in preserving descendents from the view point of existence and non-existence, which achieves stability of marital life, without harming wife's rights, and continuity of good practice marriage.
