Abstract

تعتبر المناسبة من الأدوات التشريعية المستخدمة من قبل الشرع المطهر لإنتاج العلية، وبناء الأحكام الشرعية، حيث إن الأحكام الشرعية مبتناة على جلب المصالح وتعظيمها، ودرء المفاسد وتقليلها. وقد حاولت هذه الدراسة تسليط الأضواء الكاشفة على المناسبة ، بياناً لمفهومها، واستجلاء للأدلة الناهضة بحجيتها، وبياناً لانخرامها عند المعارضة، وما صاحب القول بالانخرام من جدل أصولي بين أنصار القول بالانخرام ومخالفيهم من المروجين للقول بعدم الانخرام Abstract Occasion is considered one of the sharia tools used by the immaculate legislation to produce analogy and build sharia rules where as the legislative rules are based on realizing benefits. maximizing them defeating corruptions and making little of them. This study is meant to put light on the occasion showing its concept and exploring its evidence that support is hard proof and its falling short when contrasted or opposed and all statements that claim its desfunctioning through fundamental argument between desfunctioning proponents and opponents who argued in support of the letters.
