اجتهاد عمر بن الخطاب فيه في حد السرقة

Abstract

يتناول هذا البحث مسألة إيقاف عمر بن الخطاب لحد السرقة وعدم تنفيذه حد القطع على السارق؛ الأمر الذي خالف عمر الله فيه ظاهر النص ؛ وسوف أعرض في هذا البحث الحالات التي أوقف فيها حكم القطع على السارق وأبين المسوغات التي دفعت عمر له لعدم تنفيذ الحد، وأنه الله لم يخرج عن النص الشرعي وعمل به حرفيا راداً بذلك المزاعم التي ثارت عليه الله أنه كان جريئاً في إيقاف الحد عندما يكون غير صالح للتطبيق مع تطور الزمن، أو أنه لم يعمل بالنص الذي يكتنفه الغموض أو النقص فأراد أن يكمله. وعلى هذا يجوز تغيير الأحكام الشرعية قطعية الثبوت قطعية الدلالة Abstract This research is dealing with the issue that Omar bin al-kattab suspend the burglary punition and not to apply the punition of the abscission of the thieves hand and according to this Omar disagree with (textthe verse in Holy Qur'an) and I expose in this research the cases in which Omar suspend this punition and I illustrate the reason why Omar suspend this punition and I illustrate that Omar didn't contradict the verse in holy Qur'an but he apply it and this research repels the claims that Omar was hasty in suspending the punition when it wasn't suitable to apply because of the changes and development that happened according to the changes in time and he didn't apply that mentioned in the text (the verses in Holy Qur'an) if the text is ambiguous or incomplete and he want to complete it. According to this we can change the jurisprudential verdicts that are immutable fully confirmed and with firm purport.
