حقوق الارتفاق المتعلقة بالمياه في الشريعة الإسلامية (دراسة فقهية مقارنة)

Abstract

تهدف هذه الدراسة إلى بيان حقوق الارتفاق المتعلقة بالمياه في الشريعة الغراء، هذه القضية التي شغلت اهتماماً واسعاً قديما وحديثاً لما للمياه من عظيم الأثر في حياة الكائنات الحية، وقد كانت الشريعة الإسلامية سباقة بتقنينها والانتفاع بها وفق قواعد واضحة بيئة تحدد ملكيتها وسبل الانتفاع بها. فمن خلال هذه الدراسة سوف نسلط الأضواء على حقوق الارتفاق وأقسامها وسبل الانتفاع بها. كما تكشف الدراسة بيان الأحكام الفقهية المتعلقة بالمياه المملوكة والأحكام الفقهية المتعلقة بعمارة الأنهار وإصلاحها. Abstract This study points out to the rights of the leaning which relate to water in the Islamic Jurisprudence this case has been interested by many people in the past and present as water has great effect on the life of the living creatures. The Islamic Jurisprudence has used technique how to use the water according to vivid rules that limit its possession and ways of using in this we will focus on rights,sections and ways of useful the leaning. This study discusses the juridical judgments which relate with the possessive water, and the juridical judgments that relate with the construction and mending the rivers.
