ملخص
يهدف هذا البحث إلى بيان دور القياس كمصدر من مصادر الأحكام في إقرار الحكم بالعقوبة في باب العقوبات الشرعية، ومن ثم فقد نهج البحث إلى تتبع مذاهب الفقهاء واتجاهاتهم في إعمال القياس في الفروع الفقهية الخاصة في باب العقوبات والكفارات، والوقوف على أدلة المجيزين والمانعين لإعمال القياس، وما يرد على هذه الأدلة من توجيهات وردود، ثم الخلوص إلى ما يرجحه الفرقاء في كل مسألة، وقد نهجت الدراسة منهج الفقه المقارن في تتبعها خلاف المذاهب في المسألة وفي استقراء أدلتهم ومناقشتها والترجيح بينها، كما وهدفت إلى استقراء نماذج من مخرجات هذا الخلاف الشرعي في الأحكام المختلف عليها في باب العقوبات، سواء في باب الحدود باختلاف الفقهاء في أحكام بعضها بإجراء القياس فيها، أم في باب القصاص أم في باب الكفارات المقدرة.
Measurement in Sanctions in Islamic Jurisprudence
Abstract
This research aims to demonstrate the role of measurement as a source of sentencing in the confirmation of sentencing in legitimate sanctions. Then, the research aimed to follow the doctrines of the jurists and their trends in the implementation of analogy in the special jurisprudential branches in the section of sanctions and expiations and to identify the evidence of those who permit and prevent the implementation of the analogy, what responds to such evidence, and what jurists prefer in each case. The study adopted the comparative jurisprudence approach in tracking the disagreement between the dissent of doctrines in each case and in extrapolating their evidence, discussing it, and weighing between them. The study also aimed to extrapolate examples of the outputs of this legal dispute in rulings in the section of sanctions, whether in limits, according to the differences of jurists in some rulings by making an analogy in them, in retaliation, or the estimated expiations.
