أثر اللّجوء في تغيّر الفتوى - دراسة تأصيلية-

Abstract

ملخص يقدّم البحث دراسة تأصيليّة لقضية معاصرة مهمّة تتعلّق بتشريعات وأحكام اللاجئين، تتمثل في مدى إمكانية أن تكون حالة اللجوء موجباً من موجبات تغيّر الفتوى، ومن خلال تتبع أصول تغيّر الفتوى لدى الفقهاء والأصوليين ثبت أنّ حالة اللّجوء والخصوصيّة الذاتيّة والظرفيّة للاجئ لها أثر معتبر في تغيّر بعض أحكام وفتاوى اللاجئين، وأنّها تصلح أن تكون موجباً من موجبات تغيّر الفتوى عموماً في العصر الحالي، وتوصّل البحث إلى نتائج تقعيديّة يمكن البناء عليها في الاجتهادات المتعلقة بفتاوى اللاجئين، فقد توصّل البحث إلى أنّ من موجبات تغيّر فتاوى اللاجئين: موجب ظروف اللاجئ الاستثنائية (الظروف الطارئة)؛ وموجب الضرورة؛ وموجب النظر في مآلات الأفعال؛ وموجب تغيّر المكان؛ وموجب تغيّر الحال؛ وموجب تغيّر الأعراف والعادات. كلمات مفتاحية: اجتهاد، فتوى، تغيّر الحكم الشرعي، لجوء، ظروف استثنائية، عرف. The Effect of Asylum (Refugee status) on changing the fatwa: Original Study Abstract This research provides a fundemental study of an important and contemporary issue relating to the legislations and provisions of refugees. It is represented in the extent to which the state of asylum may be one of the reasons for changing the fatwa, and by tracing the principles of changing the fatwa among islamic jurists and fundamentalists. It proves that the refugee's own circumstantial nature has a significant impact on changing some provisions and advisory opinions (fatawa) which may be generally suitable to be an urgent need(reason) for this changing at the current time. The research showed results which can be used or based on to provide jurisprudence related to the fatawas of refugees. The research concluded that the reasons for changing fatawas depend strongly on exceptional circumstances of the refugee (exigent circumstances) such as; necessity, considering the outcomes of actions, change of place , change of situation and change of traditions and customs.
