Abstract

الملخص تناولت الدراسة مسألة ضمان العيوب في الفقه الإسلامي وذلك من خلال ذكر الشروط التي ينبغي توافرها في العيوب التي يمكن أن توجد في السلع المعيبة حتى تكون مضمونة، وهذه الشروط هي: أن يكون العيب قديماً، وأن يكون العيب مؤثراً ينقص قيمة المبيع، وأن يكون العيب خفياً لم يعلمه المشتري، وأن لا يشترط البائع البراءة من العيوب التي. يمكن أن توجد في المبيع Abstract This study has been designed to explore the issue of the hidden defects guarantee in the Islamic Jurisprudence. In order to do so conditions of the defects which should be available in the defect goods where mentioned as follows; the defect should be old; the defect should result in decreasing the value of the goods; the defect should be hidden to the buyer the goods should not be sold under the condition of "sold as seen".
