سمات المدرسة العراقية في المذهب المالكي

Abstract

الملخص يعتبر المذهب المالكي من أهم المذاهب الفقهية المتبوعة لدى أهل السنة والجماعة، و يتميز هذا المذهب بتعدد المدارس الفقهية المنضوية تحت لوائه، وتحتل المدرسة العراقية مكانا متميزا بين هذه المدارس الفقهية، حيث تشكل منهجاً متميزا عن مناهج الاستنباط الفقهي داخل المذهب، وقد حاولت هذه الدراسة تسليط الأضواء الكاشفة على تلك المدرسة من خلال إبراز سماتها الأساسية، ومظاهر الالتقاء والافتراق بين تلك المدرسة وسائر المدارس في المذهب، وصولاً إلى استخلاص جملة من النتائج و التوصيات تم إيداعها في الخاتمة. Abstract Malki School is considered one of the most important juristic school adopted by assuna and jamaa people, its distinguished by its numerous juristic school affiliated to it and it occupies a distinguished place amongst these schools whereas it forms a unique method over other juristic and interpolative ones of the same concept. This school tried to focus and high light its status through promoting its primary characteristic and points of convergence and dissonance between this school and other schools of this doctrine in a way to elicit a set of results and recommendations as a conclusion
