ملخص
تهدف هذه الدراسة إلى بيان المقصود بالدعوى الكيدية، وذكر أسبابها، وتوضيح طرق علاجها في الفقه الإسلامي، وتناولت تعريف الدعوى الكيدية، والأمثلة عليها، ونصوص تحريمها، وطرق علاجها في الإسلام.
وخلصت الدراسة إلى الأمور الآتية:
إنّ الدعوى الكيدية باطلة ومردودة، وقد حرّمتها نصوص الشريعة الإسلامية.
إنّ ما اشتمل عليه تاريخ المسلمين من الدعاوى الكيدية هو عدد قليل جدا؛ نتيجة لمعالجة الإسلام لهذه الدعاوى، وتطبيق العقوبات الرادعة لها.
The malicious lawsuit in Islamic jurisprudence: it’s concept, causes, and methods of treatment
Abstract
This study aims to clarify what is meant by malicious lawsuit and to explain ways of treating it in Islamic Jurisprudence.
The study proved that the malicious lawsuit is null and void Islam has forbidden it. And that what was included in the history of Muslims from malicious claims is very few because Islam tackled them and applied deterrent penalties.
