ملخص
يهدف البحث إلى بيان حكم تعسف الولي في أداء الحقوق الواجبة عليه تجاه الحاضن والمحضون. حيث إن بعض الأولياء قد ينحرفون في استعمال الحق بشكل لا يحقق الغاية منه، والتي جعلها الفقه والقانون في يد الأب رعاية لمصلحة المحضون، فإن أدت إلى الإضرار بالصبي؛ كان ذلك انحرافًا يجب تصحيحه.
وقد تناول الباحث معنى التعسف في اللغة والاصطلاح، وأن هذا المصطلح استقر معناه عند المعاصرين، واعتبرته المحاكم اليوم داخلًا في المسؤولية التقصيرية، وأن للتعسف معايير منها: قلة المصلحة أو انتفائها مقارنة بالضرر الذي يقع على المحضون، مثل: أن يرفع الولي دعوى لطلب إعفائه من كلفة مسكن المحضون؛ لكلفتها عليه.
ومن صور تعسف الولي بتعطيل مصالح المحضون: من استخراج أوراق رسمية له، أو عدم إلحاقه بسلك التعليم، فإن ثبت التعسف أمام المحكمة؛ نقلت الولاية منه إلى من بعده، فإن لم يوجد الأصلح؛ جاز للمحكمة نقلها للحاضن.
كما تناول الباحث تعسف الولي في الاعتراض على أحكام النفقات مع علمه بحاجة الحاضن والمحضون إليها، وعالج القانون هذا الأمر بجواز تقدير المحكمة نفقة مؤقتة أثناء النظر في الدعوى.

Abstract
This research aims to indicate the ruling on the abuse of the guardian in the performance of the rights he is due to the incubator and the concubine. Some saints may be deviant in using the right in a way that does not achieve its purpose, which jurisprudence and law have made in the father's hands the care of the beholder, if it harms the boy, it is an aberration that must be corrected.
One of the forms of abuse of the guardian is the injury of the interests of the concubine: from the extraction of official papers to him, or not to the education, if the arbitrariness is established in court;
The researcher also addressed the abuse of the guardian in objecting to the provisions of expenses knowing the need of the incubator and those who are in charge of it, and the law dealt with this order with the possibility of the court's discretion in a temporary expense during the consideration of the case.
