ملخص
تناولت الدراسة جملة من الاجتهادات القضائية في تفسير الألفاظ المشكلة في بعض الدعاوى في قانون الأحوال الشخصية الأردنية، واستعرضت صور الإشكال الواقعة في الألفاظ والأحكام وكيفية الاجتهاد للوصول إلى مقصود المشرع من خلال الوقوف على الوصف المؤثر عبر مسلك تخريج المناط وتنقيحه، ومن ثم ربط الحكم به تحقيقا في الواقعة المنظورة.
Judicial jurisprudence in explaining the problem words in the Jordanian Personal Status Law
Abstract
This study addresses jurisprudential endeavors in interpreting ambiguous and problematic terms in some legal actions involving the Jordanian Personal Status Law. The study reviews the forms of ambiguity in legal terms, and the methods of reaching at the legislator’s intent by finding their effectual characterization and the rationale behind them, then relating them to the concerned legal ruling.
