استعمال الحق لغير مصلحة مشروعة أو لقصد الإضرار بالغير

Abstract

الملخص يعالج هذا البحث قضية استعمال الإنسان لحقه، لا لمصلحة عائدة له، بل لقصد إضراره بالغير، وهو ما اتفقت الشريعة الإسلامية والتشريعات الوضعية على منعه، وعدِّه تجاوزا غير مشروع على الآخرين. وأبرز البحث كثيرا من التطبيقات في الشريعة الإسلامية، إضافة إلى تطبيقات قضائية في المحاكم العربية حكمت المحاكم فيها بعدم مشروعية تلك الأعمال، وإن كان ظاهرها يوهم تحقيق مصلحة. كما أبرز البحث المعيار الذي يحدد مشروعية استعمال الحق أو عدم مشروعيته. Abstract This research deals with using the person of his rights without any benefit or interest with the intention to harm the others or achieve benefit not permissible, that is what the Islamic Shari?a and the human law had forbidden, and they considered it transgress not legitimate on others. This research also shows a lot of application in Islamic Sharia, and judiciary application in Arab courts, and criterion that through it tells whether using the rights is legitimate or not
