الدلالات اللغوية وأثرها في ترجيح معاني غريب الحديث عند محمد الطاهر ابن عاشور من خلال كتابه: (كشف المغطّى)

Abstract

ملخص تناولت هذه الدراسة موضوع أثر البنى الدلالية (الإفرادية والتركيبية) في شرح العلّامة محمد الطاهر ابن عاشور لأحاديث موطأ الإمام مالك، في كتابه المعروف باسم: (كشف المغطى من المعاني والألفاظ الواقعة في الموطأ) وما بيّن فيه من متعارضات دلاليّة لبعض الألفاظ والتراكيب الواردة في الأحاديث النبويّة اقتضت منه الترجيح بينها، لدفع التعارض بين دلالتين أو أكثر. وقد اقتضى منا الموضوع اعتماد المنهج الاستقرائي الوصفي التحليلي للتطرّق إلى جوانب نظرية وأخرى تطبيقية: أما الجانب النظري: فقد تناول آليات الاستنباط من النصوص الشرعية، فتطرّقنا إلى الدلالات اللغوية، والألفاظ، من منظور علماء الشريعة ومنظور اللسانيين، ثم إلى الترجيح وأحكامه. وأما الجانب التطبيقي: فتمثّل في استقراء كتاب "كشف المغطّى" واستخراج الأحاديث التي رجّح فيها المؤلّف مدلولا معيّنا بناء على دلالة لفظ الحديث. وفي خاتمة البحث تم عرض نتائج البحث، بعضها ذو صلة بموضوع الترجيح كمسلك عقلي يلجأ إليه المجتهد، وبعضها ذو صلة بمنهج ابن عاشور في ترجيح التعارضات الدلالية في شرحه لأحاديث الموطأ. Abstract This study deals with the effect of the semantic structures on the explanation of Muhammad al-Tahir Ibn Ashour for the hadiths of al-Mawatta in his book: (Revealing the encircled meanings and words in al-Mawatta). The subject required the adoption of the analytical, descriptive method and approach to the theoretical and practical aspects: As for the theoretical aspect, it addressed the linguistic connotations and words from the perspective of the scholars of Shari'a, and the perspective of linguists. And weighting and its judgments. As for the practical aspect, it required the extrapolation of the book and extracting the hadithsin which the author weighted a certain meaning based on the Linguistic connotation. The results of the research were some of them related to weighting as a mental path to which al-Mujtahid applied, and some related to Ibn Ashour's approach in weighting Semantic conflicts in his commentary on the hadeeths of al-Mawatta.
