دلالة مصطلح الاستدلال عند الأصوليين وتطبيقاته الفقهيّة

Abstract

ملخص فيتغيّا هذا البحث، الكشف عن إطلاقات مصطلح الاستدلال عند الأصوليين، ومعانيه السياقيّة عند الفقهاء، مع ذكر نماذج منه، ويعالج إشكالية معاني الاستدلال، بين المصطلح الأصوليّ والتطبيق الفقهيّ، وتظهر أهميّته في كونه كاشفاً عن الدلالات الاصطلاحيّة للاستدلال عند الأصوليين، ومدى استعمال الفقهاء، لتلك الدلالات، في السياقات الفقهيّة. ومع كثرة الدراسات السابقة، يأتي هذا البحث بانياً عليها، مستفيداً منها، مضيفاً إليها قضايا مهمة جديدة. وقد توصّل البحث إلى نتائج منها: أنّ إطلاق مصطلح الاستدلال، في معنى من المعاني-عند كثير من الأصوليين- لم يكن إطلاقاً نافياً للمعاني الأخرى، وأنّ استعمال الفقهاء لمصطلح الاستدلال، جاء جامعاً لكلّ معانيه الأصوليّة. الكلمات المفتاحية: الاستدلال، الدليل، السياق الفقهي.

Abstract This research explores the conceptions of the term "inference" among the fundamentalists, and the contextual meaning of the jurists, with examples of it. It deals with the problematic meanings of inference between the fundamentalist term and the jurisprudential application, and its importance in revealing the conventional connotations of the fundamentalists' Semantics, in the jurisprudential contexts. With the great number of previous studies, this community comes to benefit them, adding to it important issues. The research concluded that the term "inference", in a sense of meaning, was not categorized by many fundamentalists, and that the use of the term "inference" by scholars was a synthesis of all its fundamentalist meanings Keywords: inference, evidence, context of jurisprudence.
