القتل بدافع الشفقة - دراسة مقارنة-

Abstract

الملخص إن حق الحياة في الإسلام حق مقدس يستند إلى تكريم الإنسان، وينطلق من مبدأ حرمة الاعتداء عليه إلا بحق، وقد أخذ يشيع في بعض المجتمعات ما يسمى بالقتل بدافع الشفقة، من أجل تخفيف آلام المريض الميئوس من شفائه ومعاناته، فالقتل بدافع الشفقة من الموضوعات المهمّة في الفقه الإسلامي فقد بحثته من خلال تعريفه، وصوره، وموقف الدين الحنيف منه، وأثر رضا المجني عليه بالقتل، حيث أثبت البحث حرمة القتل إلا بحق؛ والقتل بدافع الشفقة لم يكن يوماً بحق. Abstract The human soul is holy for god, so god prohibited it to be slain with ought sin(right). But some societies use what is called "the killing of mercy" to mitigate the pain of the patient. " the killing of mercy" is considered one of the most important matters in the Islamic juries prudence. In my research paper, I refer to its introduction, form, glossaries, view, of the Islamic legislation ? etc The research fouses on no killing with out right, and the mercy killing is not right
