الملخص
تناولت الدراسة مسألة أثر الوقت في خياري العيب والتصرية، وبينت فيها موضوع رد محل العقد باستعمال خيار العيب هل يكون على الفور أم أنه يكون على التراخي؟، وكذلك موضوع الرد بخيار التصرية هل يكون على الفور أم أنه على التراخي؟ وتبينت بعد البحث والاستقصاء أن الرد في كلا الخيارين يكون على الفور دفعاً للضرر عن البائع وتشجيعاً للتبادل التجاري.
Abstract
This study discussed the impact of time in the option of defect and holding (Tasirya), and pointed out the reply by using the option of defect either immediately or upon relaxation? Also the reply by using the option of holding (Tasriya) either immediately or upon relaxation? After research and investigation the study concluded to that reply in both cases must be immediate to protect the seller from harm and to encourage exchange of trade
