ملخص
تناولت هذه الدراسة مدى تأثير الغاية في الوسيلة وبعض تطبيقاتها في باب الجنايات والجهاد والقضاء, فبدأت ببيان ضوابط تأثير الغايات في الوسائل في الإسلام, وتناولت الدراسة بعض الأمثلة التي يظهر فيها تأثير الغاية في الوسيلة في باب الجنايات والجهاد والقضاء مع الحرص على التأصيل لكل مسألة.
وتهدف هذه الدراسة إلى بيان موقف الإسلام من نظرية الغاية تبرر الوسيلة, وبينت أيضًا ضوابط اعتبار الغايات في الإسلام وعرضت مجموعة من الأمثلة التي يظهر فيها تأثير الغاية على الوسيلة في معظم أبواب الفقه.
وتوصلت إلى جملة من النتائج منها: أن الإسلام ضبط الغايات المعتبرة ووسائلها, وأن الإسلام وازن بين المصالح والمفاسد وقدم الأنفع, وأن التطبيقات التي أثرت فيها الغاية بالوسيلة لم يكن منبعها العشوائية والهوى؛ بل كانت مضبوطة بمنهج الشرع.

Abstract
The current study discussed the effect of aims on means and some relevant applications in books of jihad, Felonies and jurisprudence, so it began with explanation of controls through which aims affect means in Islam with examples showing such effects taking into account origin establishment of each issue.
The study aims at clarifying the attitude of Islam towards the theory of “Aims Justify Means” and regulations ruling the consideration of aims in Islam with some examples indicating effects of aims on means in books of Islamic jurisprudence.
The study concluded that Islam regulated considerable aims and means and had balanced interests and abuse, giving preference to the most beneficial.Furthermore, applications, where aims affected means, have not randomly originated but regulated by the method of Sharia.
