سؤال العلاقة بين الفطرة والشريعة "دراسة في الإمكانات المنهجية"

Abstract

ملخص يتناول هذا البحث علاقة الفطرة بالشريعة في التفكير الإسلامي، وما تطرحه هذه العلاقة ليس فقط في جانب الدلالات الفكرية والمعرفية التي زخرت بها أغلب الكتابات التي ألفت في الموضوع، بل تتجاوز هذا المستوى المعرفي إلى مستوى آخر ظل غائبا إلى حد ما في التفكير الإسلامي، وهو البعد المنهجي الذي تتيحه هذه العلاقة، بمعنى الإمكانات المتعلقة بتوظيف قدرات الإنسان الفطرية في فهم وتعقّل الخطاب الشرعي والأحكام التكليفية، والوقوف على غاياته ومقاصده، واستثمار هذه الإمكانات أيضا في عملية الاجتهاد الفقهي. ولذلك تأتي هذه الدراسة لتقف على هذا البعد المنهجي، أي: كيف يمكن توظيف مفهوم الفطرة والاستناد إليه في التفكير الفقهي وفهم فلسفة الأحكام ومقاصد الشريعة؟ الكلمات المفتاحية: الفطرة، الشريعة، العقل، التكاليف، المصالح، مقاصد الشريعة. Abstract This research addresses the relationship of human nature/fitra to Sharia in Islamic thought, and what this relationship raises not only in terms of intellectual and knowledge connotations, which have largely been mentioned in the writings, but goes beyond this level of knowledge to another level that was absent to some extent in Islamic thought, which is the methodological dimension offered by this relationship. This refers to the potential to employ the innate human abilities to understand and rationalize the legal discourse and the obligation-creating rules, to understand its goals and objectives, and to implement this potential in the process of jurisprudence reasoning. Therefore, this study focuses on the methodological dimension, namely, how to use the concept of human nature/fitra and rely on it in the jurisprudential thinking, and understand the philosophy of rulings and the objectives of Sharia.
