ملخص
تعرض هذه الدراسة مفهوم التفتيش القضائي في الفقه الإسلامي، بالإضافة إلى بيان مجموعة من الألفاظ ذات الصلة بالتفتيش القضائي، سواء كانت تلك الصلة من ناحية التعريف اللغوي، أو الاصطلاحي، أو من الناحية التطبيقية للتفتيش القضائي، كما بيَّنت هذه الدراسة أدلة مشروعية التفتيش القضائي من المنطلق التطبيقي الموجود أصالةً في التفتيش على العمال والولاة والأمراء والقضاة، وكذلك تعرضت الدراسة إلى بيان حكم التفتيش القضائي والحكمة منه، وقدمت الدراسة بعضاً من صور التفتيش القضائي، وقد توصلت من خلال هذه الدراسة إلى مجموعة من النتائج، أهمها: وجوب العمل بالتفتيش القضائي ضمن معايير شرعية للحفاظ على هيبة القضاء الشرعي بصورة عامة، والحفاظ على آداء العمل القضائي بصورة خاصة.
Abstract
This study presents the concept of judicial inspection in the Islamic jurisprudence, in addition it shows a set of terms related to judicial inspection, whether related in terms of linguistic or conventional definition or from the practical aspect of judicial inspection. This study also showed the evidence of the legality of the judicial inspection from the practical point of view, In the inspection of workers, governors, princes and judges, as well as the study was subjected to a statement of the judgment of judicial inspection and wisdom, and the study presented some of the forms of judicial inspection, and has reached through this study to several results ,which the most important: Judicial inspection must be carried out within the framework of legal criteria to preserve the prestige of the judiciary in general and to preserve the performance of judicial work in particular.
