Abstract

ملخص هدفت الدراسة إلى توضيح معالم النيابة العامة الشرعية في قانون أصول المحاكمات الشرعية الأردني، ولتحقيق ذلك اتبع الباحثان المنهج الوصفي التحليلي. وتوصلت الدراسة إلى مجموعة من الاستنتاجات، أهمها: أن مشاهدة الدعاوى من قبل النيابة العامة لا تكون إلا بناء على طلبها، سواء كانت طرفاً أصلياً أم طرفاً منضماً، ويتعين على المحكمة إجابة الطلب، ولا مانع من طلب النيابة العامة مشاهدة ملف الدعوى حتى قبل فصلها، إذا طال أمد الدعوى وأرادت النيابة العامة الاطلاع على بعض الإجراءات لتقديم الرأي في مسألة معينة، أو لكتابة المرافعة الختامية في الدعوى. كما يجوز للنيابة العامة الشرعية التدخل في الدعاوى المنظورة مرافعة أمام المحكمة الأعلى إذا لم تتدخل أمام المحكمة الأدنى، وذلك في حالات التدخل الاختياري، وتتلخص الأدوار المجتمعية للنيابة العامة الشرعية في تعزيز احترام حقوق الإنسان وبخاصة الفئات المستضعفة، والمحافظة على الحق العام، وحماية الوقف والوصايا لجهات البر، وتحقيق الأمن الاجتماعي لأفراد المجتمع. الكلمات المفتاحية: النيابة العامة الشرعية، قانون أصول المحاكمات الشرعية الأردني. Abstract The study aimed at clarifying the features of the Shari'a Public Prosecution in the Jordanian Jurisprudence Law. In order to achieve this, the researcher followed the analytical descriptive method. The study has reached a number of conclusions, the most important of which are: The prosecution can not be prosecuted by the public prosecution, whether it is an original party or a party. The court must respond to the request. If the case is prolonged, the Public Prosecution wants to see some procedures for presenting opinion on a particular matter, or to write the final arguments in the case. The Public Prosecution may also intervene in cases pending before the Supreme Court if it does not intervene before the lower court in cases of voluntary intervention. The community roles of the Public Prosecutor's Office are to promote respect for human rights, especially vulnerable groups, to protect the public right, to protect the waqf , And social security for the members of society.
