الملخص
يتناول هذا البحث موضوع شركة التوصية بالأسهم، ويهدف لبيان تكييفها الفقهي، وما يترتب على هذا التكييف من أحكام، ودراسة هذه الأحكام دراسة فقهية قانونية مقارنة؛ وصولاً لما يجب أن تكون عليه هذه الشركة واقعا، ومنعا من وقوعها في المخالفات الشرعية في جوانبها التطبيقية. وقد توصلت الدِّراسة إلى أنَّ هذه الشركة من الشركات المختلطة التي تضم نوعين من الشركاء: شركاء متضامنين، وهؤلاء تطبق عليهم أحكام شركة العنان الإسلامية، وشركاء مساهمين: وهؤلاء تطبق عليهم أحكام شركة المضاربة الإسلامية، كما بيَّنت الدراسة الأحكام الفقهية المتعلقة بهذه الشركة.
Abstract
The present study addresses the subject of fiqh adaptation of Limited Partnership by Shares for purpose of identifying how to be adaptive to fiqh, outcome provisions as a result of such adaptation and investigating such provisions from fiqh legal comparative perspective so that practical basics can be identified when putting such partnership in practice, so doing would preclude its break of sharia principles. The study found that Limited Partnership by Shares can be viewed as a combined type including two kinds of partners, limited partners on whom provisions of Islamic Partnership take effect; and sharing partners on whom Islamic Speculative Partnership provisions would take effect. The study showed in practice fiqh provisions of such kind of partnership.
