أثر القضاء الإسلامي في الوقاية من الظواهر السلبية في المجتمع

Abstract

ملخص جاء هذا البحث؛ ليتناول موضوع أثر القضاء الإسلامي في الوقاية من الظواهر السلبية، فعرّف القضاء، والظواهر السلبية، وتطرق في صورة موجزة إلى مشروعية القضاء، والحكمة منه، وأهميته من خلال التطرق إلى المقاصد التي تحفظ به، كما جاء على ذكر نماذج من الظواهر السلبية وتفاوتها في المجتمع الأردني أنموذجاً، كما جاء على ذكر بعض الإحصائيات الخاصة بهذا الشأن، ويهدف البحث إلى الوقوف على سمات القضاء الذي من شأنه الوقاية من شيوع الظواهر السلبية في المجتمع؛ إذ قد يكون القضاء في بعض الأحيان سببا في شيوع بعض الظواهر السلبية، كما ويهدف البحث إلى بيان أهمية إصدار الأحكام القضائية والتعجيل في تنفيذها في تقليص الظواهر السلبية. Abstract This research came to address the topic The role of the Islamic judiciary in reducing negative phenomena it explained the meaning of the judiciary, and explained the meaning of negative phenomena, and the meaning of reducing them, it touched briefly on the legitimacy of the judiciary, the wisdom of it, and its importance by addressing the purposes that it preserves As mentioned in the examples of negative phenomena and their variability and their variation in Jordanian society as a model, as mentioned in some statistics on this matter. The aim of the research is to identify the characteristics of the judiciary that would reduce the prevalence of negative phenomena in society. The judiciary may sometimes cause some of the negative phenomena. The research also aims to demonstrate the importance of issuing judicial decisions and accelerating implementation in reducing negative phenomena.
